Unbuilt Atlas Property
If you’ve found this post the chances are you’ve made payments for an unbuilt Atlas Property and you would like to know what you can do about it. The good news is that, providing you have access to the right documentation, we should be able to assist. If you paid for an off-plan property in Spain through Atlas International and the property was not subsequently built, there is a good chance you may be able to make a Ley57/68 claim against your bank to recover your payments along with interest accrued since the money was placed in the bank account.
You can see the requirements for reclaiming your Spanish off-plan property payments on our Requirements page. One of the issues you will come across with Atlas International purchases is that payments were often made into local Atlas International offices in the UK and Ireland. This makes it more difficult to trace the payments into the Spanish bank account in question. But there is some good news on this front.
Atlas International is one of the few Spanish property agents still in operation after the property boom and bust cycle. In most cases Atlas International offices in Spain have access to files from when developments were sold and transfers that were made from it to the banks in question. If you contact Atlas and ask for these details they will provide them to you if they are available.
If you are having trouble accessing your Atlas bank transfer documentation you can contact Mandy Richards – email@example.com, who should be able to access any bank transfer documentation you require from the company.
Apart from this we would require a copy of your contract and details of any actions you’ve taken in order to recover funds from the developer. With this information we can assess your ability to make a claim for free.
If you are in a position to make a claim we will do so on a ‘No Win, No Fee’ basis, so you do not have up-front costs. If you visit our Apply Now page you can pick up a questionnaire which, when filled out, will allow us assess your case.
Do be aware that there is a 15 year statute of limitations on this claim in Spain, so the clock is ticking. It is wiser to make your application for a payment reclaim sooner rather than later.
