Reclaim Payments for Spanish Property bought through a Company
Until relatively recently it was considered impossible to reclaim payments for purchases through a company (either a Spanish or foreign company) using Ley 57/68 claims for unbuilt Spanish off-plan property.
This is because those purchasing using a company vehicle were considered to be ‘investors’ as opposed to ‘home purchasers’. Ley 57/68 was specifically set up to protect individual property purchasers, but not investors.
A new ruling, recently obtained by our Spanish office, has overturned this common belief that you cannot reclaim funds that were invested using a company vehicle.
