S E N T E N C I A  Nº 135/2015 En SEVILLA, a veinticinco de junio de dos mil quince.

El Sr. D. Fernando García Campuzano, MAGISTRADO del JUZGADO DE PRIMERA INSTANCIA NUMERO 18 DE SEVILLA y su partido, habiendo visto los presentes autos de Procedimiento Ordinario 1409/2014 seguidos ante este Juzgado, entre partes, de una como demandante IMEL GROVE SL con Procurador D. RAFAEL ILLANES SAINZ DE ROZAS y Letrado D. FERNANDO SALMERÓN SÁNCHEZ y de otra como demandado NCG BANCO, S.A.U con Procuradora Dña. MARTA MUÑOZ MARTINEZ y Letrado D. JUAN CALDERON RIESTRA, sobre reclamación de cantidad. ANTECEDENTES DE HECHO PRIMERO.- Que se presentó demanda de Juicio Ordinario con fecha 15 de Septiembre de 2014, de reclamación de cantidad, por parte IMEL GROVE S.L, representada por el Procurador D. RAFAEL ILLANES SAINZ DE ROZAS SEGUNDO.- Se admitió a trámite la demanda, dándose traslado a la demandada para que contestara en el plazo de 20 días hábiles, computados desde el siguiente al emplazamiento, contestando dentro de plazo, y señalándose día para Audiencia Previa, con los resultados que constan en autos, quedando el presente procedimiento visto para dictar Sentencia.Judgement Against DUJA Group (Royal Marbella)

FUNDAMENTOS DE DERECHO PRIMERO.- La demandante manifiesta en su escrito de demanda que el uno de marzo de dos mil siete celebró contrato privado de compraventa con Desarrollos Urbanísticos Jiménez Álvarez, Sociedad Limitada (DUJA S.L) para la adquisición de una vivienda en la promoción inmobiliaria denominada Royal Viñedos del Mar en Manilva y que entregó la suma que es objeto de reclamación en el presente procedimiento, no siendo entregada la vivienda a la demandante en la fecha pactada para la finalización de las obras, sosteniendo la actora que la demandada prestó aval de conformidad con lo establecido en la ley 57/1968, habiendo resuelto la actora el contrato de compraventa con la vendedora, estando reconocido el crédito en el procedimiento concursal seguido contra ésta, no habiendo abonado la demandada la cantidad reclamada a pesar de haber sido requerida extrajudicialmente de pago, habiendo presentado la demandada escrito de contestación a la demanda para oponerse a las pretensiones de la demandante negando la existencia del referido aval.

FALLO Que estimando la demanda interpuesta por el Procurador D. Rafael Illanes Sáinz de Rozas, en nombre y representación de Imel Grove, Sociedad Limitada, contra banca Corporación Bancaria, Sociedad Anónima, debo condenar y condeno a la mandada a abonar a la actora la cantidad de setenta y seis mil noventa y cuatro con cincuenta y ocho (76.094,58) euros, más los intereses legales desde la fecha de presentación de la demanda, con imposición a la demandada de las costas procesales.
